Cake contract, terms and conditions
A 50% save the date retainer fee is required to secure the booking of a cake. This can be paid either by cash, bank transfer or paypal only. The remainder of a wedding cake balance is due NO LATER than two weeks before the event. If payment is not made in full by this due date, two weeks before the event date, NO cake will be made and the order will be cancelled. Birthday/anniversary etc cakes balance must be paid in cash on collection or before collection, no cake will be allowed to be taken from the premises without full payment paid. Dates will not be reserved without a deposit/retainer fee. Cakes are booked in on a first paid deposit basis. Cakes by Kathryn Lovick has the right to refuse a deposit due to unavailability. Deposits/retainer fees are non-transfrrable.
CHANGES TO THE CAKE:
Regarding wedding cakes... Once the contract and waiver has been signed, the event date is reserved. The final cake design is due at least 4 weeks before the event. There shall be no changes to the design of the cake within 4 weeks of the event date. Any changes requested after this date cannot be guaranteed and may be subject to a change in price and possible fees which must be paid prior to the event by cash. All changes are subject to availability. CANCELLATION: In the event of a cancellation, payment is part refundable 6 months prior to the event date. There are no refunds applicable for event cancellations within 3 months of the event date. Refunds are 50% of the retainer fee made to cover time, any equipment and administration costs.
FOOD ALLERGIES AND FLOWERS:
Most of Cakes by Kathryn Lovick’s cakes contain butter, gluten and eggs and are made in an environment that handles nuts, soya and alcohol. Nut-free, gluten-free, dairy-free and alcohol-free cakes can be made on request but I cannot guarantee that these cakes will not contain trace amounts of these ingredients. Whilst adhering to Environmental Health guidance on cross contamination of allergens, I do my best to keep ingredients separate but they are not made in a separate kitchen so I cannot 100% guarantee it. The customer must acknowledge that responsibility for informing guests of this allergy information, and do not hold Cakes by Kathryn Lovick responsible for any allergic reactions. Fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.
LIABILITY and ACTS OF GOD:
Cakes by Kathryn Lovick are not responsible for any damage to the cake, or shortage of cake, caused by a guest, caterers, or any other person not employed by Cakes by Kathryn Lovick. If the event is outdoor, due to the effects of outdoor weather conditions, or the table on un-level ground, the wind blowing, dirt, leaves, branches, sunlight, insects and other wildlife, products such as icings, fillings, cake decorations, etc, may not hold up and cannot be insured past delivery and set-up.
In the case of an unavoidable occurrence, such as a car accident or poor road conditions during delivery, Cakes by Kathryn Lovick cannot be held liable for more than the price of the cake described in this order. If the cake is not delivered or irreparably damaged, a full refund will be given for the price of the cake. The client will provide clear driving directions to location and inform Cakes by Kathryn Lovick of any adverse road hazards and/or obstacles that may hamper the delivery and quality of finished cake. Please note that once the cake has been delivered Cakes by Kathryn Lovick will require the venue to sign off the cake to state it has been delivered in perfect condition and that the venue now hold full responsibility for the cake and Cakes by Kathryn Lovick cannot be held responsible for any damages thereafter.
CAKE COLLECTION, TRANSPORTATION AND STORAGE:
All orders must be collected within business hours, unless otherwise agreed. Once the cake has been collected and left the premises of Cakes by Kathryn Lovick it is the customers own responsibility if any damage occurs. Cakes are made with ingredients that will MELT IN HEAT and cakes should never be left in direct sunlight or in a vehicle. Cakes should be transported on a flat surface with plenty of space (the seat or on a knee is not recommended). Sponge cakes have a 1 week shelf life from the date of your collection or delivery. Rich fruitcakes last perfectly well for several month, we do not advise keeping them for several years. Cupcakes will only last about 2-3 days from the agreed collection time. Cakes will come boxed and should be left in the box at room temperature on a flat surface until required. Do not refrigerate unless advised otherwise or the cake contains fresh cream products. It is also not a good idea to store cakes in places such as a garage, conservatory, cellar or cold store or in the kitchen where it could become susceptible to steam, condensation and cooking odours. If damage occurs to the cake after collection, minor repairs maybe be able to be carried out on the same day but will incur a charge. (Acceptance of repairs of this nature will be at Cakes by Kathryn Lovick’s discretion and will depend on whether the cake decorator is available that day and the workload at the time). If an order is not collected at the agreed collection time, it will be kept for a maximum of 12 hours after this agreed collection time, and then disposed of at cakes by Kathryn Lovick’s discretion, without refund.
Complaints are rare so when they do occur they are taken very seriously. Corrections to inscriptions and minor changes when things are wrong can usually be carried out on the same day in most cases and the customer is required to give Cakes by Kathryn Lovick the opportunity to do this. The customer must notify us of the problem within 1 hour of collection. Some complaints may need further investigation and an immediate refund may not always be possible. The cake must be returned to us within 3 days so that we can fairly assess the nature of the complaint. Photographs of cakes will not be accepted. The maximum refund offered at anytime depending on the outcome of our assessment, will be the cost of the cake plus the delivery charge if the cake was delivered.
